    Session 1: “Practice of Commercial Rights Operation in Sporting Events”

    International sports events, such as the Olympic Games and the FIFA World Cup, are, while not necessarily widely known, major arenas for exploitation of various commercial rights embracing, among other things, TV broadcasting right, sponsorship and merchandise licenses. Business entities are often involved in such sports event by serving as right holders of such commercial rights, whether locally or globally. The session thus will, with the help of experienced experts in these practice areas, focus on how these commercial rights are controlled, granted and exercised, together with certain associated legal implications in terms of enforcement of such rights and policing of so-called ambush activities.

    Session 2: “Disputes in Sports and Means for Solutions”

    Recently, arbitration proceedings have gathered attention as an alternative dispute resolution ("ADR") mechanism in the field of sports. Several years ago in Japan, Ms. Suzu Chiba, a swimmer, submitted an application before the Court of Arbitration for Sport ("CAS") regarding the selection process of swimmers for the national team for the Sydney Olympic Games, which incident triggered the creation of the Japan Sports Arbitration Agency ("JSAA") in 2003. Considering that the Beijing Olympic Games will be held next year and the Federation Internationale de Football Association ("FIFA") has adopted the use of the CAS for dispute resolution and requested national football associations to address this matter, we would like to discuss the dispute resolution trends in Japan and other Asian and Pacific countries focusing on arbitration and other mechanisms used in the field of sports, which may generate much more attention of the public.
